AT&T should not have been surprised by the recent US Department of Justice (DoJ) intervention to block its acquisition of AT&T. This action represents a return to pre-2000 Antitrust enforcement. Now AT&T faces a tough – and probably unachievable target date of March 20th. 2012 to close the deal before penalties are due to Deutsche Telekom (DT). However AT&T’s US$39 Billion is probably the best deal that DT is likely to get – since DT is not willing to invest in the next upgrade for T-Mobile US, and needs to complete the deal soon, as it has significant European investment plans for the money.
